By accessing or using OrcaLumi ("the Service"), you agree to be bound by these Terms of Service. If you do not agree to these terms, please do not use our Service. We reserve the right to modify these terms at any time, and your continued use of the Service constitutes acceptance of any changes.

2. Description of Service

OrcaLumi is an AI-powered presentation generation platform that allows users to create professional, consulting-grade slide presentations from text content or by transforming existing PDF documents. The Service uses artificial intelligence to generate visual slides based on your input.

3. Account Registration

To use OrcaLumi, you must:

• Create an account with accurate and complete information
• Be at least 13 years of age (or the minimum age in your jurisdiction)
• Maintain the security of your account credentials
• Notify us immediately of any unauthorized account access

You are responsible for all activities that occur under your account.

4. Credits and Payment

4.1 Credit System

• Slide generation requires credits (1 credit = 1 slide)
• Credits are purchased in advance and do not expire
• Credits are non-transferable between accounts

4.2 Payments

• All payments are processed securely through Stripe
• Prices are in USD unless otherwise stated
• All purchases are final upon credit delivery

4.3 Refunds

Refunds for unused credits may be requested within 30 days of purchase. Refunds are issued at our discretion and may be prorated based on usage. Contact support to request a refund.

5. Acceptable Use

You agree NOT to use the Service to:

• Generate content that is illegal, harmful, threatening, abusive, or defamatory
• Create presentations containing hate speech, discrimination, or harassment
• Produce content that infringes on intellectual property rights
• Generate misleading or fraudulent content
• Attempt to reverse engineer or exploit the AI systems
• Overwhelm our systems with automated requests
• Resell or redistribute generated content as a competing service
• Violate any applicable laws or regulations

6. Intellectual Property

6.1 Your Content

You retain ownership of the content you input into the Service. You grant us a limited license to process your content solely for providing the Service.

6.2 Generated Content

You own the presentations generated through your use of the Service, subject to any third-party rights in the underlying AI models. You may use generated presentations for personal and commercial purposes.

6.3 Our Property

OrcaLumi, including its design, features, and underlying technology, remains our exclusive property. You may not copy, modify, or create derivative works of our Service.

7. AI-Generated Content Disclaimer

Our Service uses AI to generate presentation content. You acknowledge that:

• AI-generated content may not always be accurate or appropriate
• You are responsible for reviewing and verifying generated content
• Generated visuals are AI interpretations and may vary in quality
• We do not guarantee that generated content is free from errors
• You should not rely on generated content for critical decisions without verification

8. Service Availability

We strive to maintain high availability but do not guarantee uninterrupted access to the Service. We may modify, suspend, or discontinue any aspect of the Service at any time. Scheduled maintenance will be communicated when possible.

9. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, ORCALUMI AND ITS AFFILIATES SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOSS OF PROFITS, DATA, OR BUSINESS OPPORTUNITIES, ARISING FROM YOUR USE OF THE SERVICE.

Our total liability shall not exceed the amount you paid for the Service in the twelve (12) months preceding the claim.

10. Indemnification

You agree to indemnify and hold harmless OrcaLumi, its officers, directors, employees, and agents from any claims, damages, losses, or expenses arising from your use of the Service, your content, or your violation of these Terms.

11. Termination

We may terminate or suspend your account at any time for violations of these Terms or for any other reason at our discretion. Upon termination:

• Your right to use the Service ceases immediately
• Unused credits may be forfeited
• We may delete your data after a reasonable retention period

You may terminate your account at any time by contacting support.

12. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the United States, without regard to conflict of law principles. Any disputes shall be resolved in the courts of competent jurisdiction.

13. Severability

If any provision of these Terms is found to be unenforceable, the remaining provisions will continue in full force and effect.
